Look at the old contract. I did. The last year of wages, SER/MOD $34.74 - Const. $42.89 Tentative contract 1st year SER/MOD $33.81 - CONST 41.97 ? Why would we start lower than our last contract ? I know we had give backs for medical but we should start the new contract  atleast were we should have been! Also talk to employment, they said there would be no efect to our benifits. We will still get it if you vote NO!

No more hoisting of machine beams...now machines, bed plates and machine beams set in one pick.

Cylinders, pistons and Escalator trusses, dropped off and set in place .

Use of the outside hoist to to lift all motor room and "other" equipment. "such as..." what else?... Maybe those secondary sheaves and governors we forgot about. {now a part of Thyssens Fast Track method I believe} 

Use of forklifts to unload and move equipment.

The loss of hoisting all material to a staging area. 20,40, 60 elevators..escalators.. How many man hours lost?

Make it up in overtime? Maybe, if the company picks you to work it.

 And have fun fighting the nepotism with the 5 or more of the bosses relatives and neighbors hired each year

All gone forever for 6 % . Oh yea, I forgot about the Incentive money.

Too much at stake here guys. Lets not be short sighted. We must re-group, get it right, before its too late

HE IS STILL COURAGEOUSLY FIGHTING FOR HIS LIFE!!!!!!! take a moment and say a couple words on his behalf, I have 2 children ages 12 and 15, as a Father you always worry about them, you Love them UNCONDITIONALLY they are your blood.My heart goes out to Gary Haynes and his family and friends, my prayers are with you brother keep fighting!!!!...........Secondly . I would like to thank all the brothers and sisters throughout the country who have continued to communicate with me, their concerns and questions regarding our contract , which WILL effect them in 2007. They have many many questions. Third....... I have asked this ??? many times , as far as the brothers and sisters working (with Thyssen Krupp or any independents)If the tentative agreement is VOTED down, dont they go back to work????THis is what I was told .I feel this issue should have been adressed "7 days before the vote also".I also Pray we will vote for 1 contract , 1 union, ALL FOR ONE , ONE FOR ALL .....Voting on 2 seperate agreements , is ALL ABOUT DIVISION.Whether Its regarding 1 issue or 100. I also will adress some members posts at the meeting Thursday ,"politely , educated and informed from one brother to another, some of us will never forget your past. The strong get stronger . Thanks for your time. Thanks to our leaders for doing their best. LOCAL 1 WORKING MEMBERS DESERVE TO KNOW , about their futures , regarding a NO VOTE.  Once again being an outsider watching your events at Local 1 and extremely thankful that
Local 21 members could be of assistance in your fight. I read each and every post some good some
not so good (personal opinion only) some for some against and try to find a happy medium point
for my own mind knowing that in 2 years were going to be faced with the same dilemma. The problem
is its not our time to bargain, its our time to maintain and get the best we can get and if your
elected Bargaining Committee is handing you this, they feel its the best they can get at this time.
 The economy is weak and loosing ground, Oil is going through the roof and going to go higher, We
have a republican controlled House and Senate that will back these big players (meaning Big
Business). I look at some of these post and think to myself Were doing ALLOT better than the other
trades, I read several labor relation sites on other trades contracts and alot of trades are not
coming close to ours. UAL machinist taking major concessions, and we are still moving forward,
maybe only 6 6 6 but its not 22% reduction in pay and finding out our retirement is going to be
half of what it should be, I know mine will be there when I retire.
 Our contract now includes an annuity which is wonderful for the new guys coming in the
trade ( I think Local 1 has had it for awhile not sure)
 That our health care is tops in the industry (Didn't say it come cheap) In Texas we lead
the nation in employed workers with no provided heath care (27% of all employed are not provided
with any heath care)
As far as GPS its like the Internet in the 80's no ones going to stop it, Its the future of
everything, we have it hear Its no Big Deal, Wanna get some laughs put it on the train and send
it around the metroplex a few times.
6a.m. to 9a.m. Start times in Service we already have that too, never been a big issue here.
 I know there are alot more issues than just the ones I addressed.I guess my overall point
of this is not to sway anyones vote one way or the other but maybe give everyone some food for thought,
Our trade IS doing better than the others almost always has and we can think our Past, Present and Future
Bargaining Committees for that. I ask myself sometimes when I get totally disgusted with this trade WHERE
could I go and have the kind of life I have now.... Here in Texas there is no other place I could go
and have what I have now. New York may be a different story. Good luck on your upcoming vote and we are
all behind your discussion be it for or against.

  I would like to point out one thing that I see no one has brought up, in our NEW CONTRACT, page 9.

Once you pass the Mechanic's test, you have to wait for 11 months to get the pay( B.S.)

 

  I always thought you should get the rate next day. Like I always say to the Brothers And Sisters, "I rather be a Mechanic on the bench, Then a Helper working"

I never have a problem admitting when I am wrong. After actually reading the contract (three times) I see things more clearly. I won't get into a point by point explanation, but anyone who wants to e-mail me, I will be glad to discuss my interpretation of the contract.
Everyone locked out is hurting financially, but the rest of our careers will hinge on this vote. The supers I see on my recon trips look ready to keel over, and the real estate board is putting pressure on emany. The ball is in our court. Let's hold on for a few more weeks. Lets allow the lunatics to run the asylum until they drop and beg for mercy.
I hope to see a huge crowd on Thursday and Sunday.

 Brother Haynes you and your family are in our thoughts and prayers. Sorry for the length.  I am a Brother who was invited into negotiations. Our negotiating team was outstanding. We are damn lucky to have them. Every one of them brought something unique to negotiations. EMANY underestimated the strength of this Union, locally and internationally. I am surprised at what I am reading. For those of you who didn't know, there are 5 contracts in this Local.  We have BCA, CAGNY, and the Outside Hoist agreements. For 15 years there has been an Otis agreement and an EMANY agreement. There were a large amount of work rule differences. The money was always the same. We still have two contracts, but the names have changed. It is closer to one contract than it’s been in 15 years. The staggered start has been in the contract since 1993. Some of us have worked it. Some of us worked it for a long time. No one ever asked me to volunteer. I was assigned or there was no work. Now there is a cap. They have had the use of the outside hoist since 1993. Now it is limited to 100 feet and one staging area.  It must also be under the control of a local one member. In New Jersey, we do not run the outside rig. GPS was given to them in the middle of the last contract, for nothing -- Absolutely nothing. Those of you, who were in the Union Hall basement, knew it was being jammed down our throats. Thanks to the arbitration, we still have it, but it's not in the vehicle. I guess if you have a company car you can pick up groceries on the way home. The second shift in mod has been in the contract since 1996. The 7 / 8 hour construction work day? Since 1996 (maybe 1993 I lost some pages). In 23 years, I have never seen an increase in our Local over 4%. Have any of the senior members seen an increase larger than 4%? The way I see it, some items that were in the Dear John letters were moved into the body of the contract. The $2,250 was for keeping us locked out 2 weeks after the tentative agreement was signed. It was not a bribe. The idea was to get money into our pockets up front. If you work an average of 1,500 hours over the next 9 months, that's another $1.50 an hour. After 4 years, a $12.61 total package increase is a nice raise. Compounded it's about 6.125% per year, plus the $2,250 up front. Now add the extra .13 to NEIP that is not coming out of your package.  If I were an accountant I could add all of that up and tell you how close to 7% we are. We cannot move to the top of the list in one contract. Ask everyone you know outside our Local if they think it’s a good raise. Now the hard truths to swallow: Remember the pay cuts of the last 2 years and the annuity money diverted to healthcare?  Local 3 IBEW has the majority of the mod work in our area. The senior brothers can tell you that the 1972 strike is when Local 3 IBEW ate our lunch and became a serious problem, all for .25 an hour with the goal of seniority not reached. All the in roads we have made in the last few years will evaporate. Yes, we have lost work to Local 3 IBEW. How much more as a Local can we stand to lose?  How much money is left in the general fund?  How much money do we have in a strike fund? $0.00. How long before we have to pay our own medical benefits completely? How many people were prepared for this? They locked us out. We did not choose to be out of work. We need to get back to work and prepare for the next contract. We need a strike fund and a PAC fund. We need to get the Elevator Licensing Bill passed in 2 states. This is one battle in an ongoing war. Live by the contract. No shortcuts. Follow the safety policy. When your Union asks for help at a rally, or volunteers for a committee, help out. Take a day off if necessary. Come to our Union meetings. Pay your dues before your other bills and early too. We need to get our leaders back to running our Union. I believe this is the best contract available to us at this time. I have always been someone who voted no, on principal. It's never enough. We always deserve more. We risk our health and lives every day. I will vote yes for this contract. I am jaded. I was fortunate (or unfortunate) to see the realities of these negotiations. All I ask is that you keep an open mind. Listen to all the arguments pro and con. Come to the discussion meeting Thursday.  Ask your questions.  Get the correct answers from our leaders. Than vote for what you think is right for this UNION. Do not be selfish. Whatever the outcome, we are still family and as a friend has already told me “We can agree to disagree.”  I wish we were still walking the line. I actually miss some of you guys.

WE ELECTED OUR TEAM OF LEADERS AN ASKED THEM TO NEGOTIATE US A CONTRACT THEY DID NOW ON THURSDAY YOU CAN HAVE YOUR QUESTIONS ANSWERED AND SUNDAY YOU CAN CAST YOUR VOTE AS YOU WANT BUT ANYONE READING THE MAJORITY OF THIS MATERIAL FOR THE FIRST TIME HAS NOT HAD A CHANCE TO READ THE PAST CONTRACTS AND THERE LETTERS THAT OPENED THE DOOR FOR THIS ONE PLEASE BE ASSURED ALL OUR ELECTED LEADERS  REALIZE AND WOULD WORK UNDER THE SAME AGREEMENT THEY ARE PUTTING TO A VOTE ON SUNDAY IF THEY FOUND THEMSELVES NOT VOTED BACK INTO THER POSTIONS IN OFFICE.

I'm so confused.I have read the contract over and over.I don't mind several things but thats neither here nor there.I keep wondering if my father were alive what would he say?The answer that comes to mind is , He would remind me of what he made in 1966.I would rebut with the price of gas and housing.He would rebut with "you have been able to give your kids a decent life with this job"And I would rebut......True.Apprentices will be getting less annuity.Is it for emany to save money or is it to get a point across that everyone needs to step up  tothe plate and take the test  or to show that mechanics are just more of a valuable commodity.?  3 hours on call with no benefits,don't understand that one.I don't understand the lockout either. 2250  wrong wrong wrong,it should be 5000 taxed to amount to 2250 not 2250 taxed to be 1200.So the question I am left with is Can we do better?Do I burden my negotiating team who I believe pulled out every arsenal and left no stone unturned.Do I burden my brothers with the possibility of more debt.I guess I will know when I step into that booth.Now thats it,I'm not going to think about this anymore.I am going to scroll down and send a prayer to a hurt brother.

I JUST FINISHED READING AND STUDYING THE CONTRACT AND HERE IS MY TAKE ON THE MOD. CHANGES. I STARTED IN THE LATE 60'S WITH THE BIG "O"  IN THE MOD. DEPARTMENT. THE JOBS WHERE INSTALLED BY SOME OF THE BEST MECHANICS THAT YOU EVER MET.  THESE GUY NEW THE BUSINESS AND EVERY JOB WAS INSTALLED WITH PRIDE AND ATTENTION TO DETAIL. IN 1970 WE TOOK A CUT IN PAY TO COMPETE WITH LOCAL 3 EE DIVISION THEY SAID IT WOULD GENERATE MORE WORK. [IT DID'NT] AND A LOT OF THE TALENTED MECHANIC SWITCHED OVER TO HIGHER PAYING CONSTRUCTION  AND MAINTENANCE JOBS AND THE MOD DEPARTMENT SUFFERED FROM A DRAIN IN TALENT.  EXCEPT FOR RAILS MOD. DOES THE SAME WORK AS CONSTRUCTIONS AND SHOULD BE PAID THE SAME NOT LESS. THERE WILL BE ANOTHER DRAIN ON MOD.TALENT JUST LOOK AT THE FACTS   IN MARCH 2008  MOD.$38.46PER HOUR= 79,996.80    CONST. 48.19 PER HOUR =100235.20  [20,234.40 DIFFERENCE]  I ASK YOU WHERE WOULD YOU WORK?   PLUS THE WORD[ SHIFT] IS FINALLY IN OUR CONTRACT AND THAT JUST APPALLS ME. THERE IS A BIG DIFFERENCE IN THE WAY EMANY COMPANY'S AND LOCAL 3 COMPANY'S USE MOD. JOBS.  EMANY LOOKS ONLY TO THE NEXT QUARTER PROFITS LOCAL 3 COMPANY'S USE MOD. JOBS TO BUILD THE MAINTENANCE CONTRACTS AND LONG TERM CUSTOMER RELATIONSHIPS. I JUST CAN'T SEE EMANY AND THE INDEPENDENT COMPANY'S USING SHIFT WORK TO OUR ADVANTAGE.   THAT IS WHY WE MADE THEM SHOW US A NEED FOR A SECOND SHIFT THEY HAD TO SHOW US THEY TOOK WORK AWAY FROM NON-UNION AND LOCAL 3 COMPANY'S.   THAT PARAGRAPH SHOULD REMAIN IN THE BACK OF THE BOOK WHERE IT BELONGS.                                       [AND THAT'S JUST MY TAKE ON THE MOD. God morning brothers and sisters…

Brother Galas has touched upon some hard but true realities as to why these companies find themselves in the position they do. During the course of the last 5 year contract the cost of living rose exponentially in real time for us, while the union labor cost to these companies remained within the constraints of the contract for the duration of those 5 years. When the Long Island Railroad  raised the fares they don’t check our union contracts to make that raise fair to us in proportion to what the companies make from the sweat of our foreheads. When the price of gas, tolls, and milk goes up the entities that control these prices do not read our union contracts, They raise those prices based upon their needs….. So for five years the companies obligation to us and our union is based upon the language of the contract and whatever wage increases and or benefits are agreed upon, remain so regardless of how inflation affects us…..yet every year these companies use those insignificant wage and benefit increases to base their ridiculous profit projections which increase yearly at a disproportional rate compare to what we get out of the deal. As brother Galas rightly states …”these companies lose the work elsewhere because of their own ridiculous prices that have nothing to do with the cost of union labor..” and furthermore; again right on the money, brother Galas comments that Instead of treating a customer fairly with a fair price on a mod, they gouge the customer till that customer has no other recourse but to go to Local # 3 for a decent price…then when the job is lost they run back to Local #1 moaning and groaning that they can’t compete seeking a solution and all the while in the back of their minds prepare that very same scenario to use it as an excuse to get what they feel will remedy the situation comes contract end…….Perhaps is me!!.. but  I don’t see it.. what I do see is a lopsided deal that benefits them and enslaves us, Yes I’m all for new technology but until they prove to me how that technology will mutually benefit both sides I’m not buying it.. it is directly because of us that they made record profits in the past quarters yet they don’t acknowledge it and or reward us accordingly. How many times do WE go out of our way, step out of the box, and go out on a limb to sell a customer a given product only to have the whole deal go sour because of ridiculous quote, how often do they sell gold embroidered hall buttons to a customer in dire need of a controller… I personally have been responsible for selling products only to have the product delivered and lie there with no one to install it.. all the result of having decimated their own resources by reducing their work force to increase profits.. We have a damn good product.. however can’t sell it because we don’t know how to sell it and when we do, have no one to install it.. Customers calls go unanswered to the point that the customer ends up calling me inquiring as to  ..”What kind of company you work for? Here I am trying to buy what you sold me on and they won’t call me or even acknowledge my calls..” The relationship between local #1 and these companies should be a symbiotic one, where a cooperative atmosphere prevails and the association is mutually beneficial to one another.. It’s obvious that this symbiotic relationship does not exist between us and instead they’ve turn into parasites living off of us…Ever had worms? Nuff said..

Of all the human frailties.. None pervades the human soul like Greed does As defined it is simply…”a strong desire to continually get more of something, especially. money “ and as long as greed motivates these folks a common ground upon which we all can make a fair and balanced living will always remain elusive, only a dream and in turn is going to destroy the very fabric of this great nation of ours… As I have said before it all boils down to a single push of a lever.. View the contract often and objectively then let the chips fall where the may… IT IS OUR CALL NOW..AND FEAR OF REPRAISALS AND DOOM SHOULD NOT ENTER OUR MIND…BECAUSE COLLECTIVELY WE ARE STRONG…

 First of all the $2250.00 - taxes = $1500.00 is a Pay Off For A Yes Vote!! no matter how you slice it........

2) UNITED WE STAND DIVIDED WE BEG??? if so WHY DO WE HAVE TWO CONTRACTS???????????

A vote should only be done when the end result is in the best interest of all the men together collectively.  The 1700 Local 1 members who do not work for EMANY, will be voting on a contract where GPS does not pertain to them.  Why should they vote to impose GPS on other members of this union.

 

Why do we let  three company's dictate the contracts for hundreds of companies in this country??

 

With 32 years in the elevator industry, I've seen many contracts seen many strikes. What I never did see is A NO VOTE after a long lockout or strike. Whenever a negotiating team accepts a contract after a long strike/lockout and brings it to the table for a vote it is always accepted by the membership. It is obvious that now the company is in desperate need for the men to return to work - but perhaps more than that the men are even more desperate for their jobs. They accept the first contract the negotiating team presents.

What I am saying is NOW IS THE TIME TO SAY NO, when the companies are ready for us to resume work. They are not prepared for the long haul and a long hot summer in NYC.

Why should we go back?

Just because they had enough of their game, now is the time to turn this game on them. We made it this far, we can go longer!!!! Remember summer is here and it gets hot and ugly in those motor rooms...

And by the way, We should start the New Contract at the date of the signing. June/July this will be a better time of the year for us to negotiate a contract,


1) due to the heat at this time of the year,

2) In general there are more shutdowns in the summer..

3) We can simply go on vacation while they sweat in the motor rooms..3)

4) Do not revert the contract start date back to March that would be foolish on our behalf.

He is fighting for his life. He needs our support and thoughts and concern. Prayer is very powerful,Gary and his circle of family and friends needs to know we are HERE for him. You will get everything in Life , If you just help a few others. My prayers and thoughts are with Gary Haynes and his family . He needs US at Local 1 . He needs to hear from all of YOU. At this time I refuse to talk about the contract ,we all are entitled to 1 vote. I REFUSE to respond to many members posts, which I dont agree with . I will be at meeting this Thursday , as I am like every union meeting. I will as always be educated , informed and well trained. The day that I dont support the leaders in place , IS THE DAY I LEAVE LOCAL 1, I am extremely proud to be member of this fine Local . I remain positive I remain determined and FROM DAY 1 will continue to fight the fight for every brother and sister of THIS fine Local , whether we agree or not.    Look at what happened to the Longshoremen when they made concessions for their hoisting and rigging.
