WTC-SITE BLDG. COMES DOWN TODAY

December 8, 2006 -- Work will begin today to dismantle the vacant, contaminated Deutsche Bank skyscraper, which has loomed above Ground Zero since 9/11, when one of the World Trade Center towers collapsed into it, officials said.

The black shroud that has covered the 41-story building will come down floor by floor as the building is taken apart from the top down, said Charles Maikish, executive director of the Lower Manhattan Construction Command Center.

"This is a very positive action on a very difficult job," Maikish said.

He said the building will be gone in a year, creating space that is planned to house one of five new towers at Ground Zero and a rebuilt Greek Orthodox church.

The building has stood as a symbol of slow action at the 16-acre WTC site and has angered residents who wanted it removed and feared that dust within it would endanger their health.

As of today we have 123 members out of work with Local One. ( 63 operators 41 journeymen and 19 apprentices ). Please reach to these brothers or sisters during these challenging times for not only them but for their families , especially their children.

Local One is having a Toy Drive for all the children of presently unemployed Local One members. Remember we are all family , even if these members don't have children , reach out , make a call , stop and visit with some food or donations during these trying times for them. As for the children we are not asking for much, donate a gift card ? Most of all don't ignore those who could use our help, especially for the children. Let them know WE CARE!

I also wanted to strongly urge all union members to read your monthly Elevator Constructor Journals, read learn and most of all get involved in OUR UNION, continue to check one another ,for a paid union card.

Most of all lets get together , work as one and continue to educate one another . I would like to commend Local 33 and Local 4 for their very well written and truthful articles in the Elevator Journal we just received. Say yes to safety and proper testing of elevators and escalators and SAY NO TO WALMART!!! I also feel that if you have strong opinions or issues and write about them in any public format?? Please sign your name ? And why not? Work Safe and please be generous to those who have less then us all year round.

4 hospitals may drop Empire Blue Cross

Patients who find themselves having disputes with Empire Blue Cross Blue Shield have some recourse with state regulators in the event that the insurer and the Stellaris Health Network cannot reach a new contract by Jan. 1.
The state Insurance Department has a consumer hotline that operates 9 a.m. to 5 p.m. Monday through Friday. The number is 800-342-3736.
Complaints also can be filed at the Insurance Department's Web site. Go to www.ins.state.ny.us, click on the "Consumers" and then click on "Health." Go down the page and click on "How to file a complaint or make an inquiry."



In the latest episode of contract negotiations that could leave patients scrambling for medical service, four Westchester County hospitals have signaled their intention to withdraw from Empire Blue Cross Blue Shield on Jan. 1.

Without a contract, Empire patients would have to pay out of their own pockets to use White Plains Hospital Center, Northern Westchester Hospital in Mount Kisco, Phelps Memorial Hospital Center in Sleepy Hollow and Lawrence Hospital Center in Bronxville.

Empire patients may find that some of their doctors have been dropped from Empire's network as well. Empire sent a letter to some doctors on Oct. 30 warning that it would happen if they lacked admitting privileges at a hospital outside of the chosen four.

Empire said yesterday that Medicare members enrolled in its HMO and PPO Medicare Advantage plans are not affected. Both sides have settled coverage for that portion of the contract, it said.

It was unclear yesterday how serious a problem the Jan. 1 deadline poses for other patients.

Empire, the largest health insurer in the state based on PPO and HMO membership, has other Westchester doctors and hospitals in its network. In its Oct. 30 letter, it urged doctors to contact the insurer to arrange for continued care if their patients are affected.

Yesterday, both Empire and Stellaris Health Network, the Armonk organization that represents the four hospitals, issued statements maintaining that the contract talks were continuing in good faith. Both said they were hopeful a deal could be reached before Jan. 1.

Last year, however, Empire and the network representing Good Samaritan Hospital in Suffern allowed their contracts to expire for a single day while they wrangled over a new deal. The contract was settled three months later.

In 2004, patients under United Healthcare faced a similar threat when that insurer and five Westchester hospitals argued over a new agreement. Both sides struck a deal before the deadline set by the hospitals.

One doctor said yesterday that he expects Empire and the Stellaris hospitals will reach a deal before month's end. He and other medical professionals, however, were unhappy over the effect the negotiations were having.

"It's unconscionable to have patients who paid premiums all of a sudden not be able to find a doctor," said Dr. Michael H. Rosenberg, a plastic surgeon and former president of the Medical Society of the County of Westchester.

Three of the eight doctors at his practice, Plastic and Reconstructive Surgery in Mount Kisco and White Plains, are affected by the Empire-Stellaris contract, he said. The practice plans to send letters to patients on Monday notifying them of the possibility that they would need new doctors on Jan. 1, he said.

Rosenberg called Empire's letter to the doctors "pretty outrageous." It was the first time he had seen such a letter in the course of contract discussions between hospitals and insurers. Rosenberg said doctors and patients are being used as pawns in the talks.

"Here, they've raised the stakes," he said. "There's a tremendous amount of brinksmanship, and Empire is very powerful ... but at the end of the day, are they really going to throw out 15,000 patients? I hope not."

Neither Empire nor Stellaris would comment in detail on the issue, saying it could affect negotiations. Empire said it doesn't report on the number of patients it has by a particular geography.

Reimbursement rates commonly are high on the list of issues between hospitals and insurers when new contracts are negotiated. Many in the Lower Hudson Valley have complained that they receive less from insurers than hospitals in Connecticut and New Jersey get for the same procedures.

Empire and Stellaris downplayed the actions they had taken in the talks up to this point.

The notification of the canceled contract is "sometimes required by both Stellaris and the Managed Care Organization triggered by various contract terms and/or regulatory agencies," the Stellaris statement said.

Empire defended its Oct. 30 letter to the doctors in similar terms.

"Notification to some physicians is a contractual requirement, and does not mean that we will not reach agreement, just that at this time we are still in discussions," the statement said.

   If you are out of work please notify the hall on how many kids you have so we can figure out how to disburse the toys. Please also give the ages of the children.

   We have had a descent response from our members donating toys so far but we are far away from our goal. So go out and get a gift card or a toy and make somebodies holiday a GOOD one.

Once again the Local One Pipe Band does a great job! I wanted to commend brothers Dennis Steel and Bill Madden for leading the Local One Pipe & Drum band tonight at their annual Pipe & Drum Irish One Annual Raffle/Dinner Dance. Like always the party was a BIG success due to all the hard work by OUR own band and I wanted to thank all those who supported and also came out to enjoy the evening.

The band sounds better every time I hear them perform, It's a pleasure to listen and all their hard work is definitely paying off. We were told tonight that they have been upgraded to the next level in competition, for those who haven't heard they took first in the Northeast in Division Five.

Most of all I want to touch on how impressive It is to see these brothers & sisters Work together for a cause, I am extremely proud of all of them and their efforts to support one another.

 On a personal note I want to wish a good friend of mine and many others brothers Tom Ginty a fast and full recovery. Brother Tom Ginty started the Local One band many years ago , his passion is never questioned, Tom had an injury on the job last week ( He is recovering from knee surgery).

 Please donate a toy or gift to Local Ones toy drive , gifts or toys can be donated at the union Hall. Please don't forget those less fortunate then us, especially during the upcoming holiday season.

Once again I am extremely proud of our Local One Pipe & Drums Band!

     I am so glad that many of you from Local 3 read the email and looked into the IBEW International pension issue.  I always said the the IBEW was not an elevator union and I proved myself right.  If Local 3 was bitter and chose not to inform the loyal members effected by the takeovers should'nt the international help us out?  Would the IBEW ignore an electrician?  Did'nt the elevator division pay dues?  I know Tim did.  The pension is small about $100 per month, but it does'nt matter if it's $1.00 it's yours and it should not be taken away. 

 

   Tim worked in elevators since 1975.  He loved his job.  He loved his friends.  he worked mega O.T. in 2005.  Because of all his O.T. I was able to stay home with him during his illness. 

 

     Tim passed on 11/30/2006.  Tim had surgery 2/22/06, he worked 12 hour days till 2/21/2006 his last day he worked with tools.  Tim was foreman on his last job, I was so proud of him.  Tim never had a bad word to say about anyone.  He never raised his voice.  Helpers  used to line up to work with him.  He was my beloved. 

     

     Tim had a very rare cancer, anaplastic thyroid cancer.  The only known cause of this cancer is radiation exposure.  After 31 years of crawling around elevator pits and working in th eNavy Yard, the midtown and battery tunnels, various hospitals, ect, ect, who knows what he could have been exposed to.  Of course there is now way of knowing for sure but what I do know for sure is that unions must stay strong to protect the men and women of the working force. 

 

     The elevator industry is primarily male.  I believe that thyroid issues are mostly female related.  Please men, for my Timmy's sake when you have  your yearly physical please donnot forget to ask the MD to check your thyroid.  I hope that  if you guys suspect enviornmental problems that you question every issue.   I donnot want Timmy to die in vain.

re: loss of pension

    I also feel for our transferred brothers.Loss of your pension isnt easy.Like you Brad Iwas injured twice once in 2000, after which I went back to work "with my tools turning wrenches"then I had another injury in 2001 after which my knees and back were so bad I could not go back to work with my tools .I have 26 years in the local and I have a little over 21 years pension credit.

    I have not padded my pension or annuitty.Operating a car for the last 4 years I have been able to just about pay the bills,sice the end of 2003 I have worked one week and off the next so another brother could pay his bills and get benefits which is what  being in a union is all about.I have tried at the local level to get some help with tis issue of losing 60% of our pensions but I was told there is nothing they can do it is out of there hands.I spoke to someone in pension dept. and all he did was read somethig out of a paphlet to me and said there was nothing he could do.

  We will have to try to plead our case with the international leadership maybe they can help us.

  I like most brothers and sisters in this situation are not looking for a handout we just do not want to loose what we put into our pensions and be able to get reasonable healthcare so I can keep a roof over my family's head.I have been a proud member of local one for 26 years my only crime I comitted was getting hurt on the job. I am  asking for a little help from the leaders of my local.

I do not think it is alot to ask for my  President or Treasurer to help injured brothers and sisters in this unique situation,we are injured and need your help as our leaders.IS'NT THAT WHY WE ARE PART OF A UNION TO HELP EACH OTHER AND NOT TURN OUR BACKS ON EVERYBODY BECAUSE OF A FEW BAD APPLES.

RE.  Pension      I have great sympathy for the local 3 members who were so bold as to come over to local one only to find there pensions in jeopardy. I can say this because as a injured operator with local one unable to return to the field my pension will be reduced by 60%!  I cant help but think this is a little unjust as I have 23 years in and almost 16 years pensionable credit not exactly a fat pension to begin with. If anyone has any thoughts how a hit like this can be prevented please feel free to contact me.      In union there is strength.

This E-Mail is in response to the E-Mail from Pat Faranda on 11/18/06, concerning her husbands International Pension from Local #3. I also worked for Local #3 for 25 years with Flynn-Hill. When we switched over to Local #1 with Kone in 2000, we also weren't told that we could lose our International pension if we didn't keep up our contributions.I called the telephone number supplied by Pat 212-728-6206. The woman I spoke to said that our local union should have advised us of our rights before our pension lapsed. She suggested that I and anyone else in the same boat write a letter stating our grievance to:Mr. Jon Walters (trustee for IBEW pension benefit fund) 900 7TH STREET N.W., WASHINGTON D.C. 20002
