card number 1179 Comments: November 26, 2006 One in seven Brevard elevators don't comply Early this year, 6,400 passenger elevators in the state -- about one in six -- did not have required certificates from the state saying they had been inspected and deemed safe. Since then, the state's Bureau of Elevator Safety completed one statewide "compliance sweep" to ensure elevators receive mandatory inspections and their operators pay an annual fee. A second sweep is under way. The result: Almost 7,900 elevators around the state now have expired safety certifications, including one out of every seven in Brevard County. The violations include elevators in local hotels, hospitals and high-rise condos. An elevator without a current operating certificate isn't necessarily unsafe. But flaws in the state's inspection and paperwork process have led to tragedy, an examination of the system found. And the breakdowns continue to expose shortcomings in the state's effort to turn over responsibility from government inspectors to a corps of private contractors that barely existed in the first place. A FLORIDA TODAY investigation earlier this year found the state had awarded an operating certificate for the elevator at the Rinker cement silo in Port Canaveral in August 2004, even though the elevator hadn't passed a safety inspection in years. Serious safety flaws -- problems that should have been uncovered by an inspection -- led to the death of 34-year-old Jorge Lozano when he fell down the elevator's shaft in the 165-foot tall silo. "That should have never happened," said Charles "Hub" Williams, a recently retired state elevator inspector who examined the elevator after the accident. "It was very, very preventable." A follow-up FLORIDA TODAY examination of elevator-inspection records found some questionable numbers:
The state's compliance sweeps were successful, said Meg Shannon, spokeswoman for the Department of Business and Professional Regulation, which oversees the Bureau of Elevator Safety. They have rectified thousands of violations to keep those elevators inspected and certified as safe. Still, thousands more elevators don't have current certificates. Many of them have not been current for years. "The bureau is currently looking at ways to address the issue of recurrent delinquent unit owners," Shannon told FLORIDA TODAY in an e-mail. "However, it's important to note that since implementation of the elevator sweeps, there has been an overall reduction of 2,633 newly added delinquent units from year-to-year," she said. "The state's elevator operators, who are statutorily responsible for the safe operation of their equipment, are getting the message and coming into compliance." Dubious records Jan. 3, 2005, was a busy day for elevator inspector 0063, according to state records. Very busy. On that first Monday of 2006, he inspected 34 elevators in or around the University of Central Florida's Orlando campus, according to a database of elevator inspections posted online by the Bureau of Elevator Safety, the agency in charge of monitoring the state's 300 or so private elevator inspectors. In fact, said Robert Szelc, he spent a month inspecting elevators at the university. The state's records were way off. "There is no way I do 34 in one day," Szelc said. "I probably do six or eight a day. Maybe 10 if they are all two-stops." FLORIDA TODAY accompanied Szelc as he inspected the elevators at Space Coast Credit Union's three-story headquarters on Wickham Road in Suntree. All the steps -- including riding on top of an elevator car to check safety latches inside the shaft -- required at least an hour. Szelc, a 46-year elevator industry veteran, said he does a couple of big jobs each year during which he spends a week or more inspecting elevators and dating all the paperwork at the end of the process. Shannon blamed paperwork mistakes for most of the questionable data found by FLORIDA TODAY. "Nothing that we found would have given the appearance of fraud," Shannon said. Shortcut worries Szelc and other inspectors worry some elevators might only receive perfunctory inspections before being deemed safe. In fact, serious accidents have occurred in elevators that apparently passed inspections. Teale Didomenico, an 11-year-old from upstate New York, learned that while in Boynton Beach in April. While waiting for her aunt to enter, Teale held open a third-floor elevator door. Suddenly, the elevator began to drop. Stunned, Teale tried to dive out of the elevator. She didn't make it. Instead, she was caught between the landing and the top of the car, with her head outside the car and her feet dangling inside. It took firefighters 20 minutes to rescue the girl. She spent four days in a Delray Beach hospital before returning to New York. She suffered internal injuries and still is being evaluated at a hospital in Buffalo, said Samuel Yaffa, a lawyer representing Teale in a lawsuit against the owners of the complex and ThyssenKrupp Elevator Corp., the company that serviced the elevators. An inspection in November 2004 uncovered no violations in the elevator. But an inspection immediately after the accident found nine. Carroll Crawford, the inspector who did the post-accident inspection, characterized the violations as minor and said the elevator was safe. Still, he said he was perplexed as to why the elevator fell. "As an elevator man, the one thing I don't want to hear is for the elevator to move with the door open." Problems for owners Meanwhile, paperwork glitches also have caused problems for building owners. Jerry Shea, the president of Xanadu condominium association, was surprised to learn from FLORIDA TODAY's earlier report that one of the two elevators in his 15-story Cocoa Beach building did not have a current operating certificate. He checked with the company that maintains the two elevators and found it had made an error in forms it sent to the state. The elevator received its updated certificate within three weeks. "It is a strange system where the state depends on private inspectors," Shea said. Those working in the elevator industry in Florida say nothing is inherently wrong with privatized elevator inspections. It's just that the state does a poor job overseeing the process, they say. "Privatization has no bite," Szelc said. "The state has the bite, but they don't use it to push the companies." A state auditor general's report released in December echoed those criticisms, claiming the Bureau of Elevator Safety had data reliability problems and an inadequate oversight process. Lee Rigby, a former state supervisor of inspectors and now president of Vertical Assessment Associates, said the state's army of private inspectors receives little guidance, especially on how to interpret state regulations. When the state ran the program, he said, inspectors were fairly uniform in how they conducted inspections and interpreted regulations. "Now, we have 200 each with their own interpretation," he said. Most of all I agree with this sister regarding going forward with this union. We need to stand united behind the elected officials. We will have the opportunity to change who is leading this union in June 2007. I feel very strongly though until then we need to Unite. Do I agree with Ray Hernandez all the time? Absolutely not but he is the president of OUR union, If I do disagree with Ray or any elected officer or brother I will speak directly to them. Did you know that if you did not continue to pay to the IBEW you lost your international pension? I don't know what we were suppose to pay or who we were suppose to pay it to. At the time of the transition from Local 3 to Local 1 there was a lot of hostility and no one was willing to help me obtain the information. recently I applied for my husbands pension from the IBEW and I was informed that his pension was void. This does'nt seem fair since Tim paid his dues for 27 years. I'm going to pursue this. If anyone else is effected you can call the international at 202-728-6206. Please call and protest this if you are effected. there is strenght in numbers. The pension is small but every little bits helps when you retire. The pension is the International pension not the Local 3 pension.
Also for those who knew Tim Faranda, Schindler, Tim continues to fight his terrible cancer but your prayer and best wishes are needed. Perhaps his friends can send a card to help his spirits during this holiday season.

Otis, a United Technologies Corp. company, and three of its competitors face European antitrust fines. According to Bloomberg News, the world's largest elevator maker along with Schindler Holding AG, ThyssenKrupp Krupp AG, and Kone Oyj will be penalized. The Brussels-based European Commission formally charged the four companies last month. Fines may be announced later this month. The commission alleges a price-fixing cartel took place in Belgium, Germany, Luxembourg and the Netherlands between 1998 and 2004. The four companies control about 75 percent of the global elevator and escalator market. Fines are expected to break the 2001 record of $2.36 billion. Since Neelie Kroes became European Commissioner for Competition in November 2004 she has made busting cartels in the 25-nation EU her top priority. Under EU law, the commission can fine companies accused of operating a cartel as much as 10 percent of their annual sales, though fines usually run from 2 to 3 percent. According to Bloomberg, the four companies had a combined sales of approximately $107 billion in 2005. Commission Spokesman Jonathan Todd declined to comment on the charges. Otis spokeswoman Tizz Weber would only acknowledge that last year an internal investigation at Otis had shown some European employees may have violated competition law. Schindler, the second largest maker of elevators, is "waiting for the commission decision," said Ivo Zimmerman, spokesman at the Hergiswil, Switzerland-based company. Schindler is fully cooperating with the investigation. Monica Soffritti, a spokeswoman for ThyssenKrupp of Dusseldorf, Germany, had no comment. ThyssenKrupp is the third largest elevator company. Minna Mars, spokeswoman for Kone of Helsinki, Finland, the fourth largest elevator maker, said Kone has not been informed of a pending commission decision, but the company was continuing to cooperate with the commission. Accordingly, I will be at your facility on December 4, 2006 to begin the week's review class. All the terms and conditions remain the same as those presented in our last proposal; specifically, the cost per person will be $800.00, all inclusive (application fee, review seminar, and certification exam). This cost is only good for Local 1 members -- the seminar and exam fees are higher for the "general public." The review course runs Monday thru Thursday, and the exam is given on Friday.
