Roy Chelsen, a heroic 9/11 first responder, died yesterday after a long battle with cancer. He was 51.

On 9/11, Chelsen, of Engine 28 in Manhattan, rushed a group of firefighters out of the World Trade Center's north tower moments before it collapsed, saving their lives.

Then he stayed on at Ground Zero, spending weeks digging through the rubble. He was later diagnosed with incurable bone-marrow cancer linked to his time there.

Blood drives were organized in his honor, and last month, he received a stem-cell transplant after a long and difficult search for a matching donor.

"This was so sought after that once he finally got the match we were calling it his new birth date," said Kevin Murray, a friend and fellow firefighter. "He got the match - finally - after five years."

Murray is among the firefighters who credit Chelsen with saving his life on 9/11. Chelsen saw the south tower collapse and returned to the north tower to tell firefighters there to flee.

"We ran out of the north tower because of him," Murray said. "He ran back through all the jumpers to grab us and rush us out."

Chelsen will have a lasting lifesaving impact because of all the people he inspired to register as blood and bone-marrow donors, friends believe.

"The legacy that he'll leave is opening the door for this blood bank to get massive amounts of people in," said Pete Gleason, a former firefighter who was Chelsen's lawyer. "It saved lives during his lifetime and it will continue to save lives."

Chelsen, who lived in Warwick, Orange County, died peacefully at home surrounded by family and friends about 6 p.m. yesterday, Gleason said. He is survived by his wife, Trish, and son Christopher, 24.

   I just got some sad news; Roy Chelsen, former Local One member and son of retired local one member Lief Chelsen and brother to local one member Steve Chelsen passed away today.  Roy left locale one to become a New York City Firefighter sometime around 1985.  He death is a result of the heroism shown on 9/11.  I’ll have more info as soon as Steve gets back to me tomorrow.

NYC attorney Steven J. Schwartzapfel, a New York City Elevator/Escalator Accident Lawyer says that often unscrupulous building owners focus on profit over public safety when it comes to maintaining, repairing or replacing elevators and escalators.

Poorly maintained elevators and escalators often lead New York City elevator and escalator riders to serious injury or even death, says Steven J. Schwartzapfel during the recent National Elevator Escalator Safety Awareness Week.

“All too often, unscrupulous building owners put profit over public safety when maintaining, repairing or replacing these elevators and escalators,” says Schwartzapfel, whose personal injury law firm, Schwartzapfel Partners, P.C., represents consumers injured or killed in elevator or escalator accidents throughout New York City.

“Unfortunately, when a slumlord cuts corners, it often leads to consumers -- men, women, children and the elderly -- suffering head injuries, broken bones, fractured arms and hips, and in the worst cases, death,” Schwartzapfel says.

According to the Consumer Product Safety Commission, 11,000 people are hurt each year when elevators malfunction and another 10,000 people go to the emergency room as the result of defective escalators. NY1 News reports that there are more than 60,000 elevators and 2,200 escalators in New York City alone.

These elevator accidents and escalator accidents occur even though this equipment is subject to strict safety laws and regulations. According to Schwartzapfel, many of these accidents result as property owners look to save money by cutting corners and skimping on repairs, maintenance and replacement.

Elevator riders often suffer injuries when the elevator cab doesn't stop in line with a floor, gets stuck between floors or plummets causing serious injury to the rider. Escalator accidents frequently involve defective or loose metal teeth that hook onto shoes, clothing or fingers.

“By properly maintaining, repairing and/or replacing this equipment and using highly trained and skilled union mechanics, property owners and landlords greatly reduce the risk of these accidents,” Schwartzapfel says. “Making sure the elevator or escalator is safe is a basic duty that a building owner owes to the public.”

If a person is injured due to a defective elevator or escalator, Schwartzapfel suggests contacting an experienced elevator accident or escalator accident attorney to learn more about how to hold a negligent building owner or landlord accountable for any injuries suffered, and to recover money for medical expenses, lost wages and pain and suffering.

As of today we have collected $2000 dollars worth of Christmas gift cards. This time last year we collected $12,000 dollars worth of Christmas gift cards. This year due to the heavy unemployment, we unfortunately have more BROTHERS AND SISTERS who need our help this year then last year! We need to start getting these cards into the hall. ("Start Elevator"), was arrested earliertoday on one count of mail fraud and one count of falsestatements to the Government in connection with a scheme to underpay employees of his company.
Manhattan U.S. Attorney PREET BHARARA said: "Byallegedly paying workers significantly below the minimum wage,John O’Shea lined his own pockets with more than $1 million whiledefrauding his workers out of hard-earned money during difficulteconomic times. Today’s arrest sends the clear message that wewill continue to work with DOI and NYCHA to stop individuals andcompanies that engage in corrupt schemes to underpay workers."
DOI Commissioner ROSE GILL HEARN said: "This defendant shortchanged his workers of more than $1 million and filedfictional payrolls with the City to cover-up his crimes,according to the indictment. But DOI investigators worked withthe City Housing Authority to expose this fraudulent scheme thatpaid some workers only one third the lawful hourly rate. Today'sarrest is a wake-up call to any publicly-funded contractor who
ignores prevailing wage law - arrest and prosecution await. DOI will continue to work with U.S. Attorney's Office for theSouthern District of New York and its fellow City agencies touncover and stop this kind of illegal conduct."
New York City Housing Authority Chairman JOHN B. RHEAsaid: "I applaud the collaborative efforts of the NYC Departmentof Investigation, DEO, and the US Attorney's office for theirthorough and expert investigation of Start Elevator, Inc. This arrest is a warning to all NYCHA contractors and businesspartners that dishonest financial activity and underpayment ofworkers will not be tolerated."
According to the Indictment, which was unsealed earliertoday in Manhattan federal court:
From 2002 through 2007, JOHN O’SHEA participated in ascheme to submit fraudulent certified payrolls to the New YorkCity Housing Authority ("NYCHA"), which overstated the actualpayments made to employees of his company, Start Elevator, forwork pursuant to federally-funded NYCHA contracts. These contracts were for the repair, maintenance, and modernization ofelevators at housing developments for low-income individualsthroughout New York City.
In the course of this scheme, O’SHEA caused the filingof fraudulent certified payrolls to NYCHA indicating that StartElevator’s employees were being paid the federal prevailing wage,as required by federal law. Relying on these certified payrolls,NYCHA issued payments to Start Elevator for work performed by itsemployees. In actuality, however, employees of Start Elevatorwere being paid far less than the federal prevailing wage. For instance, although the lowest applicable federal prevailing wagefor Start Elevator employees working on NYCHA contracts was arate of $39.23 per hour for mechanics and $23.51 for apprentices,O’SHEA paid numerous employees as little as $12.86 per hour formechanics and $12.00 per hour for apprentices. Between 2002 and 2007, the total amount of salary underpaid by O’SHEA to StartElevator employees working pursuant to NYCHA contracts was inexcess of $1.1 million.
JOHN O’SHEA, 46, of Bronxville, New York, faces amaximum total sentence of 25 years in prison if convicted.
Mr. BHARARA praised the investigative work of DOI andNYCHA in this investigation.
