Elevator crushes worker in Brooklyn

A Queens man was killed Friday - a day after his 27th birthday - when an elevator in a Brooklyn residential building plummeted five floors and landed on him as he was working, police said.

Stephen Laviscount, who worked for Pro Elevator, was in the basement of the Boerum Hill building working in the shaft when the elevator dropped. Two other men were working above it.

Laviscount, of Astoria, was bleeding "profusely" from his head and chest after the accident, a fire department source said.

It was unclear what caused the elevator to fall, police said.

The elevator had been closed since Monday for "modernization," police said. And residents had been forced to use the stairs as the repairs were being done, police said.

Laviscount was transported to Brooklyn Hospital Center in serious condition. He was pronounced dead shortly afterward, authorities said.

Laviscount's family was at the hospital, but did not want to talk about what had happened.

"He was a hardworking man," said a relative who didn't give his name.

Great day yesterday at the Local One picnic. The weather was great, the food was great, the soda???? was great, and the company was fantastic. The bagpipers were excellent as usual.

Thanks to the picnic committee for putting together another excellent picnic. Especially Bob Stork, Sue Noble and Lenny Legotte. 

Thanks to Local 4 and 91 for showing their support to Local One. We don't forget who our friends are!!!!

Tommy did do a great job. If the prevailing wage is based on Local One wages then the cheaper labor incentive to contractors is eliminated meaning more jobs for good union members who go to meetings and pay there dues.

Billyburg Elevator Mechanics Recover $215K in Labor Lawsuit

WILLIAMSBURG — The U.S. Department of Labor has recovered nearly $215,000 in back wages for 25 workers employed as elevator mechanics by Robert Elevator Co. Inc. and Morgan Vertical Consultants Inc.

Robert Elevator was a subcontractor to Lindsay Park Housing Corp., which was performing work under a contract awarded by the New York City Department of Housing Preservation and Development (NYC DHPD) that was subject to the Cranston-Gonzalez National Affordable Housing Act of 1994.

The contract involved maintenance and repair of elevators located in seven buildings comprising Lindsay Park Housing Corp’s Mitchell-Lama Housing Complex in Williamsburg, and an investigation by the NYC DHPD disclosed violations during the period of March 20, 2002, through Aug. 5, 2003.

“An investigation initiated by the NYC DHPD revealed that Robert Elevator did not pay the 25 elevator mechanics the correct prevailing wages and fringe benefits during that period, including underpayments to 17 apprentices that were not registered or enrolled in an approved apprenticeship program,” said Phil Jacobson, the Wage and Hour Division’s district director in New York City. “When the company refused to pay the back wages, the agency referred the matter to the Wage and Hour Division for resolution.”

Negotiations to resolve the matter involving the Wage and Hour Division, the Labor Department’s Regional Solicitor’s Office, Lindsay Park Housing Corp. and Robert Elevator resulted in a settlement agreement approved by the department’s Office of Administrative Law Judges, which provides for the 25 workers to receive a total of $214,983 in back wages. The city of New York is currently withholding $184,983 that will be applied to the settlement. The balance of $30,000 will be paid by the prime contractor, Lindsay Park Housing Corp.

The Housing Act of 1994 incorporates the provisions of the Davis-Bacon Act, which requires the payment of prevailing wages and benefits to laborers and mechanics employed on federal and certain federally funded projects. The Labor Department’s Wage and Hour Division enforces the Davis-Bacon and Related Acts (DBRA).

last i knew our vacation hrs. are from  jan. 1st to june 30th...i received my vacation ck and it is to the wk ending 6/25..the ck is not due till 7/15..this leaves everyone 5days short in vacation hrs if you worked during the days of 6/25 -6/30......maybe its like jeter being called out at third trying to steal, because the throw beat him without a tag...maybe im not aware of the rule change...

Hope all had a great 4th and remenbered Our boys overseas. We were extremely happy and grateful to hear from our Son in Iraq, in between missions he WROTE AN E-MAIL and  gave us a call via satellite and so far our prayers have availed much and the boys of B Company 2nd Platoon are ALIVE and well accomplishing what they went there to do..
Your continued support and prayers are greatly needed and appreciated, these boys are performing their duties under extreme conditions, 150 degree heat during the day, temperatures in the 90's at night, humid, dry..living in like mice in crowded tents and running missions with little or no sleep under hostile environments. Often in between missions during the heat of the day the generators stop running and they have to endure hot tents with no AC . All in all without complaining, surviving day by day mission after mission, with no hesitation or thought of who will die next..By the way THESE are MY Son's words ..Not mine after every sentence he writes he always adds..."BUT IS ALL GOOD DAD..WISH I WAS HOME BUT I'M GLAD THAT I'M HERE DOING MY PART FOR OUR COUNTRY'S FREEDOM. GOOD BAD OR INDIFERENT THE COST OF FREEDOM ISN'T CHEAP IS PAYED IN  BLOOD...I PARALLEL TO OUR FAITH DAD..THERE'S NO REMISSION OF SIN WITHOUT THE SHEDDING OF BLOOD..AS CHRIST SHED HIS BLOOD FOR US,  SO DO ME AND MY MEN GLADLY SHARE OURS FOR FREDOM'S SAKE.
