Effective July 18, 2008

OSHA 10-hour Construction

Safety and Health Course – S1537-A

This provision is an addition to the existing prevailing wage rate law, Labor Law §220, section 220-h. It requires that on all public work projects of at least $250,000.00, all laborers, workers and mechanics working on the site, be certified as having successfully completed the OSHA 10-hour construction safety and health course. It further requires that the advertised bids and contracts for every public work contract of at least $250,000.00, contain a provision of this requirement. Page 1 of 2

Rules and regulations will be promulgated and posted on the NYSDOL website www.labor.state.ny.us when finalized.

    Requirements for OSHA 10 Compliance

    Chapter 282 of the Laws of 2007, codified as Labor Law 220-h will take effect on July 18, 2008. The statute provides as follows:

    The advertised specifications for every contract for public work of $250,000.00 or more must contain a provision requiring that every worker employed in the performance of a public work contract shall be certified as having completed an OSHA 10 safety training course. The clear intent of this provision is to require that all employees of public work contractors receive such training "prior to the performing any work on the project."

    The Bureau will enforce the statute as follows:

    All contractors and sub contractors must attach a copy of proof of completion of the OSHA 10 course to the first certified payroll submitted to the contracting agency and on each succeeding payroll where any new or additional employee is first listed.

    Proof of completion may include but is not limited to:

    1. • copies of bona fide course completion card;

    2. • training roster, attendance record of other documentation from the certified trainer pending the issuance of the card.

    3. • other valid proof

    **A certification by the employer attesting that all employees have completed such course is not sufficient proof that the course has been completed.

    Any questions regarding this statute may be directed to the New York State Department of Labor, Bureau of Public Work at 518-485-5696.

Brothers & Sisters,

On Saturday, June 21st at 10:00AM, there will be a safety rally a the Old Deutsch Bank (Liberty Street across from G.Z.) to the steps of City Hall.
The rally is to be headed up by Joe Graffagnino Sr., who lost his son along with another firefighter in that terrible fire last August (who could forget).
Two unnecessary deaths due to the sloppy, lax and unenforced safety codes of New York City.
City, State and Private Contractors are just pissing on our backs and telling us that it is raining when they say that they care about safety !!!
Seventeen construction deaths (that we know about) this year so far and it is only June !!!
Luckily for us, most of the elevator companies signed up with Local One, show genuine safety concerns.
They give us safety equipment, guidelines, meetings, etc.
But what they can't control is the environment that we use them in.
No matter what department you are in, BE AWARE !!! BE AWARE !!!
I believe rallies such as this will make an impact on the people that want to cut corners that cut our lives short !!!
So come on safety committee, organizer and all of us !!!
Let's jump on this thing and make it happen at the meeting on the 19th.
Let's break out the banner, get behind it and show em', we are LOCAL ONE, we are here and we care.
The only way we are going out is with a margarita, a beer and a retirement party, not a god damn bloody body bag !!!

Sometimes it takes a little nudge to get things moving, but in any case the hiring list seems to be back on track, that is, its being updated on a regular basis, as it should be.  The union, in particular the officer that takes care of the list should be aware how important it is to keep the list current so that the 130 something members and their families can check it on a daily basis to see how fast or slow it has been moving.  Also, as long as I'm on the subject, whatever to the time when the union use to use its connections with the other trades to get our members jobs?  I can recall the times when I was laid off, "fired," or on strike that I could always count on my union to put me somewhere, anywhere.  What happened?  Whose to blame, and what is being done to put the unemployed back to work?  These are important questions that need answering.  Well, I've said my peice, now let's hear some comments from the outfield. Until the next time, God willing, work safe, work union, stay healthy, and God Bless.

Having just gotten over my third bout with cancer, "The Big C," and not having looked over the numerous comments in the Guest Book for quite awhile, I glanced over them and one in particular caught my attention which I felt compelled to respond to.
Brother Brian Link's 05/18/08 posting stated that the present group of elected officers are doing a good job of keeping the members informed.  Good for them, but isn't that what they are suppose to be doing?  There is, however, one officer that seems to be slow, moving like a turtle with a broken leg, in keeping the members informed.  Why does it take a minimum of two weeks to update the hiring list?  Why can't it be updated on a weekly basis, is it that hard to do?  Another statement of Brother Link's that disturbs me is the fact that he was glad to hear that it will be mandatory for ALL apprentices to attend the Labor Day Parade.  To me, it not only borders on a discriminatory act but also appears to be in violation of Federal Labor Law.  Under the Taft-Hartley Law it specifically states that union members do not have to participate in union activities, that their only obligation for maintaining membership is their periodic payment of union dues.  No action by the union, of its bylaws, or that of its Constitution, can supercede Federal Labor Law.  In retrospect, I myself have marched in many a Labor Day Parade and I enjoyed the comraderi of my union brothers, especially at the end when we got to Yorkville and hit a few pubs.  If I wasn't so old and decrepid I'd still love to participate.  In any event, good luck and best wishes to all the brothers and sisters in the local.  Stay well, work safe, and God bless.

Riefenhauser makes pitch for a comeback

DOBBS FERRY - A lift off the pitcher's mound was the last thing Gary Riefenhauser needed. Not only could he walk just fine, but with the way his fastball hummed during warm-ups he looked strong enough to pitch seven innings. Maybe eight if needed.

That fact was of little interest to Sean Paul and Frank Scattaretico. The Dobbs Ferry seniors scooped up their teammate like a heavy box and moved him across the third-base line to the home bench.

Riefenhauser, perched on their shoulders, looked both overwhelmed and a little embarrassed. He also wanted to know if the pitch he'd thrown was actually a strike.

"You didn't give it to me?" Riefenhauser asked the umpire.

"No," the ump responded. "It was a strike."

To the senior righty, it was a pitch with meaning.

Riefenhauser threw it exactly one month after a six-hour surgery to remove a tumor and a cyst from his cerebellum, but he recovered quickly enough to take the field in uniform for Dobbs Ferry's final home game, which he started with a fastball over the inside corner for a strike to Pawling leadoff batter Michael DeVito.

Dobbs Ferry beat the Tigers 13-3, but the final score hardly mattered. It was that first moment, the one that left teammates overjoyed and his mom in tears.

Even DeVito rested his helmet in the dirt and began to clap.

"We didn't know what to expect," said Diane Riefenhauser, Gary's mom. "Let's face it. You're getting brain surgery. You don't know what functions you're going to come out with, what complications you'll come out with. This is a gift as far as we're concerned. And he knows it's a gift. He's thrown himself back into life, and it is wonderful."

It wasn't always. Back in March, Gary began to feel dizziness. He had taken medication for both a sinus infection and allergies, but changing meds didn't stop what his mother called "the headache that never went away overnight."

"It got really out of hand," Gary said. "I couldn't turn around in class without getting dizzy."

Riefenhauser made two starts in April. He beat Blind Brook, but struggled in a 10-7 loss to Valhalla on April 18, surrendering 10 runs, six of which were earned, and 11 hits in four innings.

"I was hoping it would go away," he said, "but it just didn't."

After a frustrating 3-2 loss to Sleepy Hollow on April 21, coach Ted Huffman brought his team to Gould Park to run. Riefenhauser's head hurt so much he ran holding it in his hands. The next day he went to his pediatrician, who transferred Riefenhauser to the Children's Hospital at Montefiore in the Bronx. That day he not only learned of the tumor, but was admitted to the hospital and had surgery the following morning.

Luckily, the tumor was benign. His doctor, Rick Abbott, originally thought Riefenhauser would need three days in intensive care, six days in the hospital and a week of rehab. Instead, he showered on his own in two days and was home just four days after the procedure.

The recovery never slowed. A week later, Riefenhauser returned to school. A week after that he began an internship at school under a forensics teacher.

He was cleared to practice this week and finally threw off the mound on Thursday.

"When he took BP he did well and when he pitched he threw pretty hard," said junior Ryan Riefenhauser, Gary's younger brother. "Everyone was shocked."

Huffman and Dobbs Ferry athletic director Jim Lindsay contacted Pawling to ask if its leadoff batter could take a pitch to start the game. The phone calls set up yesterday's goose-bump moment.

Riefenhauser threw about 25 warm-up pitches. Only one thing appeared unusual.

"This was the hardest he's ever thrown the ball," Huffman said.

"I felt a little rust, but I was thankful," Riefenhauser said. "It just felt good to know I could throw again."

No help needed there, either.

Thursdays union meeting was one of the better ones in a while. Attendance was better, we spoke about some important issues. I would like to echo brother Bill Maddens statement at the microphone, if every brother or sister could bring ONE person to next meeting ? That would be a step in the right direction. I must say the present group of elected officials are keeping us well informed. We are looking for volunteers at the Union Picnic as well as the Labor Day Parade on Sept 6th.
We had some discussion regarding our concerns regarding upcoming contract on March 17th 2009 ( less then 10 months away). I also would like to reach out to the younger members regarding their attendance and/or involvement in our union??? Do you think things will get better if you continue to sit idly by? Most importantly work safe and look after one another at work and at home. Brother Mike Riegger said the unpaid union quarterly cards are getting better but still out there, how can this be WE ALL MUST challenge one another for each others paid union card . I was also glad to hear all attendance at the Labor Day Parade will be mandatory for ALL apprentices.
Memorial Day is coming up PLEASE remember all those who have sacrificed their lives and or served in the military so we can be safe here in America,
I will as always remain a very involved , educated and truly proud card carrying member of Local One. PLEASE GET OUT AND VOTE
