He also has some other so called elevator companies on the run and he will eventually get all of the bad guys. Great job and keep up the good work.

START ELEVATOR STOPPED: COMPTROLLER THOMPSON DEBARS WEST 4TH STREET SUBWAY STATION CONTRACTOR New York City Comptroller William C. Thompson, Jr. announced today that his office had debarred Start Elevator, Inc. and several related entities for willfully violating state prevailing wage laws by underpaying elevator repair and construction workers who performed work on public projects. Comptroller Thompson also reached a settlement with Start Elevator and Prude Construction Corporation that requires them to pay $257,649 in restitution to cover back wages and interest for 23 underpaid workers and a civil penalty for the City of New York. “Start Elevator was entrusted to install Americans with Disabilities Act compliant elevators in a New York City subway station, but broke the law by underpaying its employees the wages they were owed,” Thompson said. “Start Elevator also shortchanged workers it dispatched to other City and State elevator repair contracts. The company thought it could ignore prevailing wage laws. But now, in addition to the monetary consequences, Start Elevator must pay a heavy price by being excluded from bidding on future City and State contracts.” Thompson continued: “I applaud both the MTA and the DOT for their work and especially for reaching out to my office with their concerns of possible labor law violations. By working together, we can protect workers’ rights and ensure that contractors respect prevailing wage laws.” “I am very pleased with the outcome of this investigation,” said MTA Inspector General Barry L. Kluger. “My office will continue to aggressively enforce the New York State Labor Laws on all MTA contracts to protect the rights of the workers and ensure that the MTA is getting the quality work it’s paying for.” The New York City Metropolitan Transportation Authority (MTA) contracted with Prude Construction to upgrade the elevators in the West 4th Street Subway Station on the Eighth Avenue line to comply with Americans with Disabilities Act (ADA) requirements. Prude Construction subcontracted with Start Elevator to perform the work. Start Elevator also provided elevator repair and maintenance work at various locations for the New York City Department of Transportation (DOT). The MTA Office of Investigator General (IG) began an investigation when several workers reported that they were being underpaid. The IG investigated the allegations and subsequently forwarded the case to the City Comptroller’s Office. Similarly, the DOT contacted the Comptroller’s Office with suspicions of labor law violations on its contract with Start Elevator. The Comptroller’s investigation covered Start Elevator’s work for the MTA from March 2004 to December 2004 and for the DOT from April 2005 to July 2006. Comptroller Thompson’s Bureau of Labor Law resolved the two matters with Start Elevator simultaneously. In accordance with the stipulation, Thompson collected a total of $234,226 in back wages, benefits and interest due to 23 workers, as well as a civil penalty in the amount of $23,422. The stipulation also provides that Start Elevator willfully violated the prevailing wage laws. Given the New York State Department of Labor’s January 2008 determination that Start Elevator also underpaid its workers and willfully violated the labor law on a separate State contract, all Start Elevator entities are now debarred from submitting a bid on or from being awarded any public works contract or subcontract with the City or State for five years. Since 2002, Comptroller Thompson has debarred 29 contractors. The New York City Comptroller enforces State laws that require private sector companies to pay employees prevailing wages and benefits when they work on “public works” contracts with the City for construction or building services. The New York State Department of Labor enforces the prevailing wage law for contracts let by State agencies. The City Comptroller also enforces New York City’s living wage law that sets minimum wage rates for security guards employed by City contractors, home attendants, day care workers and several other job titles when they are employed by City contractors. card number 1347 Comments: Dear Brothers & Sisters, First of all congrats to the four retired brothers! Thank you for all being involved in OUR local, may God Bless you all for a long and healthy retirement. It also made me proud to read that our President and Business Agents all attended the party. Ask yourself how do you want to be remembered or acknowledged? It feels great when others show support for others, after all we need to continue to put others before us . Well It's less then 1 year to our next contract. We all need to be more involved , we all need to more politically active OUR LIVELY HOOD DEPENDS ON IT. This week is the beginning of April so start challenging one another for a Paid Union card , the new quarterly cards are GREEN. If you are working on a job with more then one trade ask him/her to show their paid card. We all need to work together and look after one another. Regarding the last union meeting, I thought It went very well, our elected officials are keeping us informed , I am very grateful for that. I would also like to commend brother Mike Halpin on his hard work and efforts with the organizing committee. Their were some good issues brought up to the mike. We need to address some of these bigger jobs that have other trades doing our work! It's real simple ask for their card, if it doesn't say IUEC let them go home so you can work. It's our work , regardless of the task . Call your shop steward , call your business agent, call your employer. PLEASE PLEASE don't sit idly by and do NOTHING. On another note we all need to keep improving our skills , we need to go past our present education and make yourself the most valuable asset not only for this union or your present employer but for yourself and YOUR FAMILY. I would like to see the meetings we were talking about regarding the new contract possibly on different nights or even Saturdays to go forward. How about getting together with some of your brothers/sisters and see whats important to them? Whats the major concerns in all fields? Shoot me an email or a call? Lets be prepared and informed and educated . Our elected officers need to have ALL of our concerns and questions . Most importantly work safe and look after one another. Also a quick shout out to brother Mike "Murray" Riegger on doing an excellent job in your new position, sometimes the "news or numbers" aren't great but you are doing one hell of a job! card number 1386 Comments: Brothers and Sisters, I just wanted to take the time today to thank all of you who contributed to The Robert F. Tipaldi Memorial Scholarship Fund. Last night was a tremendous success,and all who attended had a fantastic time. I was reflecting today at how wonderful my family and friends really are. Sometimes we lose faith in people, but I must say I have been humbled by the turn-out and the generosity that was shown last night and throughout the past three months. We raised over $30,000.00, that's Thirty Thousand. WOW!!!!!!!! A special thanks goes out to Brother Geezer Guy Cerbone who presented my wife with The Medal Of Valor he received 14 years ago for his heroics at the first World Trade Center Bombing. I can't even begin to find the words to describe what an honor it was for us to receive the medal and what we thought was the most touching display of compassion on his part. card number 1347 Comments: Dear Brothers & Sisters, Our next union meeting is March 20th, less then one year before our present contract expires on March 17th, 2009. We all need to start informing our Elected leaders what's important to us. I ask of all of you now, whats important to you? your family? our industry? our future? I would like to start some type of open discussion at our upcoming union meetings. Possibly even have some open forums on other dates. As long as we all can present ourselves to one another as professional and well informed , educated and truly concerned and proud members of Local One IUEC. Our present leaders need to be informed of whats important to us by " the membership", our leaders needs to hear the concerns of our membership from all fields. Our contract should be a win- win for a member in all fields . Service , Modernization and Construction should all be willing to vote for or against (regardless of which field they presently work in) or even more importantly what company they work for? These are obviously some of my concerns, but we all need to be more involved so OUR LEADERS who we elected can be well informed and well prepared going into our next negotiations . PLEASE bring your concerns and good ideas to the next union meeting, call your business agent, be part of the solution NOT THE PROBLEM! I will as always continue to be a truly concerned , involved , educated and proud dues paying member of Local One IUEC. card number 1182 Comments: This past Wednesday evening I visited Brother Dan Sheppard at The Memorial Sloan-Kettering Hospital in Manhattan where he is waging a battle against Non-Hodgkins Lymphoma.Some of you may know Dan from working with him at Otis or FujiTech or as an operator on a job-site you worked on.He is a second generation Local #1 Elevator Constructor and stand up union man that I am honored to call a friend and brother. During my visit, I was inspired by his strength, positive outlook and good humor at such an arduous time in his life, and touched by the love and support of his wife and children. I was also humbled when I asked if there was anything at all I could do for him or his family.He requested only that I get the word out to the membership that blood donations are desperately needed at Sloan-Kettering in the war against Cancer.That's Danny Boy.Even in the middle of his own fight, he still thinks to help others. My deepest condolences on the passing of brother Richie Fromodig , I worked with Richie many moons ago at Columbia University when we both worked for Armor Elevator, may you rest in peace my brother , who was also known as Richie " from otis".
